Terms of Use

1. Parties, scope and binding effect

These terms are between INDEX Labs, the operator of the INDEX mobile app ("INDEX", "we"), and the person using the app ("User", "you"). The app provides video and photo sharing, music, following, rankings/scores and social interaction features.

Your explicit electronic acceptance expresses your intention to enter into this agreement. The time of acceptance and the accepted document version are recorded for security and evidence. A new version with material changes may require your acceptance again.

2. Eligibility, accounts and security

To use the app, you must have the capacity to enter into a valid agreement under applicable law. If you are a minor, you must use it with permission from a parent or legal representative where required. Mandatory rules concerning children remain applicable.

You are responsible for providing accurate, current information, protecting your account and sign-in methods, and promptly reporting unauthorized use. You may not open an account for someone else, impersonate anyone, or transfer your account for abusive purposes.

When signing in through Google or another third party, that provider's terms also apply. We are not responsible for those providers' account security or outages except to the extent of our own fault.

If you use INDEX for an organization, you represent that you can bind it and that these rules also apply to it. Unauthorized account access, opening accounts to evade enforcement, unlicensed bulk data collection and reselling the service are prohibited, subject to uses expressly permitted by law.

3. User content and the license you grant

Ownership of the photos, videos, audio, music, descriptions and other content you upload remains with you or the relevant rights holder. You may upload only content that you own or have the rights to use, reproduce, adapt, publish, communicate to the public and grant the necessary permissions for.

By uploading content, you grant INDEX a worldwide, non-exclusive, royalty-free license to host, cache, transcode, reproduce, technically adapt, distribute, display and communicate it to the public, to operate the service and provide the content according to your visibility settings. The license may be sublicensed only as necessary to providers engaged to deliver the service. It ends when the content is deleted, except for reasonable backup and legal retention periods.

You represent and warrant that your content does not infringe third-party copyright, trademarks, personality, image, privacy, data protection or other rights, and that you have obtained the necessary permissions for people and locations appearing in it.

Keep evidence of required licenses and permissions and provide it for a reasonable rights review. If you make an original sound available for reuse, you must also secure the rights required for other users to use it through the app’s tools. This license does not authorize us to use your content in a separate advertising campaign or acquire unrestricted personality rights.

4. Responsibility for music and copyright

You warrant that you hold all necessary permissions, licenses and rights for the music, recordings, compositions, performances and other audio you upload or include in a video's original audio. Finding something online, purchasing it or crediting the source does not by itself give you the right to share it.

The catalog within INDEX with verified license information is provided for convenience; you must still comply with the stated license conditions. You are responsible for copyright and related rights in music added from outside the catalog or included in your recording. Following an infringement report, content may be removed or muted, access restricted, or account sanctions applied.

To the extent permitted by mandatory law, the uploading user is responsible for third-party claims concerning user content, infringement or failure to obtain necessary permissions. This provision does not remove INDEX's statutory obligations that cannot be excluded by agreement.

5. Community rules and prohibited conduct

Illegal content, child sexual abuse, explicit sexual content, hate, threats, harassment, bullying, glorification of violence, encouragement of self-harm, fraud, dangerous activities, disclosure of personal data, spam, fake engagement, malware, intellectual property infringement and impersonation are prohibited.

You may not attempt to bypass service security, collect data with automated tools, manipulate scores or rankings, reverse engineer, overload infrastructure or disrupt other users' experience.

6. Moderation, reporting and enforcement

INDEX may refer user reports to authorized administrators, hide or delete content, change audio for copyright reasons, restrict accounts, temporarily suspend them or ban them. Serious violations may lead to deletion of the account and associated content. Reasons for actions are logged for audit. You may contact support for the reason for a decision and a review of your appeal; applicable duties to notify and give reasons remain in effect.

Users can report a video or photo through Share > Report, report an account from its profile menu, select a reason, add details and block accounts. The reporter's identity is not disclosed to other users or the reported account; authorized administrators can see it for review. Lawful requests from authorized authorities remain applicable. Abusing reports is prohibited. If you believe a decision is incorrect, you can appeal to support with your username, the decision and your reasons.

Content may be temporarily removed upon receipt of a valid copyright or illegality report. Repeated or serious violations may result in account closure.

Reviews consider severity, repetition, safety risk, context and available evidence. Some information may temporarily be withheld to preserve evidence, prevent imminent harm or comply with law. You may request human review through support; statutory independent appeals and judicial remedies remain available.

7. INDEX scores, rankings and service changes

INDEX scores, categories and rankings measure visibility/engagement within the app; they do not guarantee monetary value, income, prizes, investments, employment or recognition. Scores may be corrected following cheating, technical errors, moderation or algorithm updates.

Features, the catalog, storage, ads, the ranking method and technical limits may change. Appropriate notice will be given for material changes affecting user rights. The service may be temporarily interrupted for planned maintenance or security needs.

8. Third-party services

Third-party providers may support authentication, hosting, video/image delivery, notifications, advertising and app store functions. They may have their own terms and privacy practices. INDEX is responsible for data processing and security obligations within its selection and instructions, and for independent third-party acts to the extent of its fault and legal responsibility.

9. Deleting accounts and content

You can permanently delete your own photos and videos using Delete on the content screen. You can delete your account through Settings > Delete account. Deletion removes the account and associated user data from active systems; limited records required for security, disputes, fraud prevention, legal obligations or backup cycles may be retained for the relevant period.

Account deletion cannot be undone. Independent copies reshared by others, records that must legally be retained and anonymized statistics may fall outside the scope of deletion.

10. Disclaimer of warranties and limits of liability

The service is provided "as is" and "as available" to the extent permitted by applicable law. Uninterrupted, error-free or secure operation, suitability for a particular purpose, accuracy of content, or follower, score or ranking outcomes are not guaranteed.

INDEX does not exclude liability for its own intentional misconduct or gross negligence, bodily injury, mandatory consumer rights, non-excludable data protection duties or other matters that cannot legally be limited. Otherwise, to the maximum extent permitted by law, liability is not accepted for indirect damage, loss of profit/data/reputation or unforeseeable consequences.

User posts are users' statements; INDEX is not deemed to have approved or verified them in advance. Its right and responsibility to review properly submitted reports and fulfill statutory obligations remain in effect.

Only for business users acting outside consumer capacity, and where lawful, our aggregate liability for claims that may be limited will not exceed the greater of the total fees paid to INDEX for the relevant service in the preceding 12 months and USD 100. This cap does not apply to the exceptions above, mandatory local rights or INDEX’s deliberate violations. We will use reasonable efforts to mitigate interruptions beyond our reasonable control.

11. Indemnity, assignment and the entire agreement

To the extent permitted by law, you must cover documented losses and reasonable defense costs directly attributable to your fault when third-party claims result from unlawful content, missing rights or your culpable breach of these terms. You will receive reasonable notice and an opportunity to participate in the defense; no settlement imposing additional obligations on you will be accepted without your consent. This obligation excludes loss caused by INDEX’s own fault and does not override mandatory consumer rights.

The invalidity of one provision does not affect the others. Failure to exercise a right is not a waiver. INDEX may assign the agreement as part of a service transfer or restructuring, provided user rights are not materially reduced.

12. Governing law and disputes

Turkish law governs these terms, excluding conflict-of-law rules. This choice does not remove non-waivable consumer, data protection or other mandatory rights in your country of residence. You retain access to local courts, consumer bodies or regulators where the law provides it; these terms impose no mandatory arbitration or blanket class-action waiver. You may first contact support, but doing so does not suspend legal deadlines.
